City Council approves up to $10,000 fines and year-round enforcement on illegal fireworks

The Sacramento City Council voted Tuesday to approve new penalties of up to $10,000 for illegal fireworks and to allow year-round enforcement. The ordinance updates the Sacramento City Code and takes effect immediately as an emergency measure.

The new law increases fines for violations involving dangerous fireworks or their use near parks, schools, or critical infrastructure. Penalties now start at $1,000 for a first offense, rise to $2,500 for a second offense, and up to $5,000 for additional violations. A $10,000 fine applies in high-risk areas or for the manufacturing of fireworks.

“Illegal fireworks have caused significant damage and distress in our city,” said Fire Marshal Jason Lee. “The changes are aimed at reducing fires and improving public safety. With stronger penalties and expanded enforcement, we can better protect residents and hold violators accountable.”

The ordinance also strengthens social host liability. Property owners and renters may be held responsible if illegal fireworks are used on their property, unless they take immediate steps to stop the activity and contact law enforcement.

The City’s Illegal Fireworks Mitigation Task Force will now operate throughout the year, using complaint data and mapping tools to focus enforcement. Safe and Sane fireworks remain legal for sale and use between June 28 and July 4, during limited hours.

City officials said the changes were necessary ahead of the July 4 holiday and in light of ongoing wildfire risks. Revenue from fines will help offset enforcement and response costs.

How to report illegal fireworks in the City of Sacramento

Residents reporting illegal fireworks should call the non-emergency fire number at 916-808-3473 (FIRE).

They also can use the free Sacramento Fire Department Community App, which is monitored by the Sacramento Fire Department.

Please note that the City is not always able to immediately respond to reports of illegal fireworks due to the volume of calls received. If staff are not able to respond immediately, they will follow up on the reported information as soon as possible.
